Constitution and Confederation Essay

Constitution and confederation are two different stories having different scenarios. Talking about confederation, it is the time when the country is ruled by leagues or parties having their rules set up by themselves. A treaty is created to establish relations between states or between countries hoping to live a peaceful life. In contrary to this, a constitution is the guiding principles in light of which the states and organizations are governed. Set of multiple rules gathers and forms the constitution. However, revisions are being made time to time so that the constitution gets better and by the time. The transition from Articles of Confederation to Constitution by United States government was based on many economic and political factors. Also, it was believed that these articles were weakening the government at a greater extent. With the passage of time, the weakness became more highlighted. The first government by the article of confederation unified thirteen states which fought for the American Revolution. The article of Confederation failed after eight years of ruling due to its biased techniques. (Independence Hall Association in Philadelphia)

Many of the states were strengthened in this article ship while the government as a whole became weak. The article of confederation mains purpose was to gather the states and form a unified platform for that. Every state was independent, but the government as a whole was responsible for minor things of common defense which were already handled by the state governments themselves. The lack of Congress strength in taxation in formulating policies is what lead the actual damage of Confederation began.

There were many reasons behind its weakness. No matter how big the Congress is, there was only one vote specified for the Congress. The Congress with majority had no role in taxation. The economy suffered a lot in this because the Congress was not given the right to take part in e-commerce and in regulating the foreign policy. The strength of the foreign policy is what forms the strong economy of the country to be strong or weak. Every country’s strength lies in its judiciary when there are judiciaries the people get their rights. Judiciary system of the country had fallen in the time of article ship. There were no judiciary courts and no national court system at that time, so the people had fewer chances of getting free of speech and acts. Unanimous votes were what that lead to the changes in the article. After the Shays’ Rebellion, some economic and military weaknesses were revealed. After this, in the hope of creating a stronger national government, Americans began asking for changes to Articles. During 1780, some issues arose which escalated the debate of government status to be state government of federal government. This led to shifting from Articles of Confederation to Constitution. Mainly the economic crisis affected the lives of so many Americans that were a part of the Congress. The fight ended, but the fight left the country with so many economic crises, mostly affecting the trade of the company. The future of the young nation of the country was under so many dangers. The threats trade had to face after the economic instability was so high that the people became worried about the future of the children. Problems were not only faced at the national level but the international level as well. These issues affected the road to constitutional government. A constitutional government needs assets and wealth for the government to establish since any reforms introduced in it are formed by money and power. (Robert Steward) So the road to transition was in danger after the economic crisis of the 1780s.

The three portions of the United States government are the Legislative, the Executive and the Judicial. Congress is the legislative branch. The legislative branch of any country is responsible for forming rules and regulations that will be followed by the whole country as a whole. Other than this the proper execution and imposition of the laws fall under this portion of the Unite States government. The two houses Senate and Representatives take equal part in the legislature. President, Vice President, and other executives from the executive portion of the United States government.

The major approval for the legislature after the Senate and House of Representatives is given by the Executives. The last and the third portion of United Sates is the judicial. The Supreme Court and the lower courts compose the Judicial Branch. The judiciary must interpret the laws of the United States. A bill becomes law after passing through the three portions of the government of United States. However, a check and balance in maintained in all portions of the government, so no injustice is observed in any part of the country. Check and balance and the three major portions are what constitute the structure of the government of United States.

Amendments to the constitution in the United States compromises of a set of steps followed to make the amendments. The amendments are made if two third of the legislature is in favor of the amendment otherwise the amendment is rejected immediately without even giving a second consideration.
